Quella che Mill presentò in poche pagine fu una teoria dei diritti dell'individuo, culminante in una serie di rivendicazioni del tutto ragionevoli. Certamente è incompatibile con qualsiasi forma di società totalitaria; ma risulta anche incompatibile con qualsiasi società talmente libera da potersi riclassificare come selvaggia, ovvero una società nella quale a dominare sono nuovamente i più forti od i più astuti. Il presupposto indispensabile, la condizione necessaria allo sviluppo della libertà, anche secondo Mill, è l'esistenza di una società civile avanzata, regolata da uno stato, minimo, di diritto.
